WDC ELECTRONIC-TICKET License 


Notice: This disclaimer does not pertain to individual game copyrights, which are non-copyrighted materials. It however strictly prohibits re-broadcasting of chess matches. Using content for the purposes of selling or charging a user fee is strictly prohibited. Media, chess players, organizers and spectators are legally permitted to download a PGN file from the MonRoi World Databank of Chess for purposes of printing and reviewing the game and publishing chess articles. We kindly ask media to include www.monroi.com source. 

1. Right to Use
Upon delivery of your access code (the “Ticket”), MonRoi Inc. grants you the limited, non-exclusive, personal right (the “License”) to view in real-time all chess matches for the tournament to which you have subscribed (the "Tournament") broadcast via the World Databank of Chess (“WDC”). This License is for your sole and personal enjoyment and use, for the duration of the Tournament. Any other use must be authorized in writing by MonRoi Inc. At the end of the Tournament, your Ticket will automatically lapse. 

2. Restrictions to License
Unless you have executed a written agreement with MonRoi Inc. to the contrary, any transmission to a third party, public representation or communication to the public by or for telecommunication, by any means, and any storage by any means of part or all of any of the chess matches broadcast via the WDC, are expressly prohibited. Without limiting the foregoing, resale of part or all of any of the chess matches broadcast via the WDC is strictly prohibited. The arrangement in a database of part or all of any of the chess matches broadcast via the WDC is also expressly prohibited.

3. Abuse 
You hereby agree not to make any abusive use or use contrary to normal use of the Ticket. To this end, should MonRoi determine that you are in breach of the License terms, MonRoi Inc. may, immediately upon written notice sent by electronic mail, regular mail, registered mail or by telecopier, interrupt your access to the Tournament and terminate your Ticket without refund of the purchase price. For the purposes of Section 5 below, such termination shall be deemed a termination with cause.

4. Copyright 
The WDC or any part of the WDC, namely and without limitation, the user interface, the software, the source code, the web-pages, the collection of archived chess matches, the information, the notes, as well as all broadcasts made via the WDC are the exclusive property of MonRoi Inc., or where applicable, its affiliates and business partners. As such, all of the above-described information is protected by Copyright under Canadian Laws and International Conventions, and any use other than as expressly permitted in this License is strictly prohibited.

5. Termination
At any time during the Tournament, you may waive the License rights granted to you by sending a written notice to MonRoi Inc. by electronic mail, regular mail, registered mail or by telecopier. Such waiver of your License shall not entitle you to a refund of your Ticket purchase price. Your failure to comply with any of the obligations herein provided will result in termination of this License, and cancellation of your Ticket, without refund of the purchase price, the whole immediately upon written notice sent by electronic mail, regular mail, registered mail or by telecopier.

6. Exclusion of Liability
Notwithstanding anything contained herein to the contrary, in no event shall MonRoi Inc, its directors, officers, employees and agents, as well as its suppliers and business partners have any obligation or liability, nor shall there be any right, claim or remedy against MonRoi Inc., its directors, officers, employees and agents, as well as its suppliers and business partners for any direct, indirect, incidental or consequential damages as a result of your purchase of the Ticket, and broadcast of the Tournament via the WDC. While MonRoi Inc. undertakes to provide you with the most reliable resources available, you understand that temporary interruptions of service are possible when dealing with the Internet, and that chess match availability and accuracy are contingent upon data entry by the players and tournament officials. Therefore, without limitation to the foregoing, MonRoi Inc, its directors, officers, employees and agents, as well as its suppliers and business partners shall in no case be liable for the availability of the WDC site, as well as any web page, archived chess match, information or data contained therein. MonRoi Inc., its directors, officers, employees and agents, as well as its suppliers and business partners shall also not be liable for the availability, reliability and integrity of the information contained within the WDC, or for the transmission, or downloading of any data. You understand that MonRoi's obligations within this License, and with the purchase of your Ticket are to use reasonable commercial efforts to provide you with access to the Tournament, and that any obligation of result is expressly denied. 

7. Jurisdiction
This License and your Ticket shall be governed by the laws in force in the Province of Quebec, Canada. The parties consent to the exclusive jurisdiction of the courts of the Province of Quebec and of Canada, in the City and District of Montreal, for any action, suit, or proceeding arising out of or relating to this License.
